1. Acceptance of Terms

PLEASE READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY. BY ACCESSING OR USING THE ROCKETBAY WEBSITE, MOBILE APPLICATIONS, OR ANY OTHER SERVICES PROVIDED BY ROCKETBAY (COLLECTIVELY, THE "SERVICES"), YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICES.

These Terms apply to (a) the website made available by Haloweave ("we," "us," or "our"), a partnership firm, for its product RocketBay at www.rocketbay.co (the "Website"), (b) RocketBay's mobile application(s) (each, an "Application" and collectively, with the Website, the "Platform"), and (c) the products, services, features, technologies, and/or functionalities provided by HaloWeave via the Platform for RocketBay (collectively, with the Platform, the "Services").

2. Eligibility and Registration

By using the Services, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into these Terms;
• You are not barred from using the Services under applicable law;
• You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3. RocketBay Services Overview

3.1 RocketBay Marketplace: RocketBay provides a platform for sellers to list and sell digital products to buyers. RocketBay is not a party to any transaction between buyers and sellers and does not guarantee the quality, safety, or legality of any products or the accuracy of any listings.

3.2 Payment Processing: RocketBay facilitates payment processing for transactions on the platform. By using our payment services, you agree to comply with our payment policies and the terms of our third-party payment processors.

3.3 Content Hosting: RocketBay may host and deliver digital content on behalf of sellers. We are not responsible for the content of these products and do not endorse any opinions expressed therein.

4. User Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws, regulations, or third-party rights;
• Posting or transmitting any content that is unlawful, offensive, or infringing on others' rights;
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services;
• Taking any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure;
• Uploading invalid data, viruses, worms, or other software agents through the Services;
• Impersonating another person or otherwise misrepresenting your affiliation with a person or entity;
• Harvesting or otherwise collecting information about others, including email addresses, without their consent;
• Using any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Services or its contents.

5. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by RocketBay, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ROCKETBAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ROCKETBAY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

IN NO EVENT WILL ROCKETBAY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

8. Indemnification

You agree to defend, indemnify, and hold harmless RocketBay, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Contributions, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Bengaluru, Karnataka, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

10. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

12. Shipping Policy

RocketBay primarily deals with digital products, which do not require physical shipping. For digital products:

• No physical shipping is involved.
• Products are delivered electronically to the buyer's specified email address or made available for download through our platform.
• Delivery is typically instantaneous or within a few minutes of purchase completion, subject to payment verification.

In the rare event that a seller offers physical products through our platform:

• The seller is solely responsible for shipping the product to the buyer.
• Shipping costs, methods, and timelines are set by the individual seller.
• RocketBay does not handle, ship, or take responsibility for the delivery of physical products.

13. Refunds and Returns Policy

Given the nature of digital products, RocketBay maintains a strict no-refund and no-return policy:

• All sales are final once the digital product has been delivered or download access has been provided.
• No refunds will be issued for purchased digital products.
• There is no option to return digital products once they have been delivered or access has been granted.

This policy is in place due to the following reasons:

• Digital products can be easily duplicated, used, or distributed after delivery.
• It's not possible to verify if a digital product has been "returned" or deleted from the buyer's device.
• Many digital products provide immediate value upon access, such as information products or software licenses.

Exceptions to this policy may be considered in the following cases:

• The product was not delivered or is completely inaccessible due to technical issues on our end.
• The product is materially different from what was described in the listing.
• Fraud or unauthorized transactions (subject to investigation).

In these exceptional cases, please contact our support team at hello@rocketbay.co within 48 hours of purchase. Each case will be reviewed individually, and any decisions regarding refunds are at the sole discretion of RocketBay.

We strongly encourage all buyers to carefully review product descriptions, requirements, and any available previews before making a purchase. If you have questions about a product, please contact the seller or our support team before completing your purchase.
